AN ORDINANCE TO AMEND ORDINANCE NO. 3.04.04 OF JONESBORO CODE OF ORDINANCES PROVIDING FOR AN INCREASE IN THE VALUE OF PROPERTY WHICH CAN BE SOLD WITHOUT COMPETITIVE BIDDING AND FOR OTHER PURPOSES

BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF JONESBORO, ARKANSAS:

 

SECTION 1: That the Mayor for the City of Jonesboro, Arkansas may sell or exchange any municipal supplies, materials or equipment without competitive bidding, if such supplies, materials or equipment have a value of $10,000.00 or less.

 

SECTION 2: In the event the value of said supplies, materials or equipment to be sold or exchanged exceeds the sum of $10,000.00 the city council shall have the authority to authorize the sale without competitive bidding.  However, in no event, supplies, materials or equipment having a value of more than $25,000.00 shall be sold without being submitted to competitive bidding.

 

SECTION 3: The rest and remainder of said Ordinance except as expressly amended herein, shall remain in full force and effect.  Further, in the event any portion of said ordinance is held to be invalid, the remaining portion is in full force and effect.

 

SECTION 4: That the authorization currently granted by the present ordinance unduly restricts the development and the orderly growth of the City of Jonesboro, Arkansas in the handling and conduct of its business.  Therefore, this Ordinance is necessary for the preservation of public peace, health and safety, there is hereby declared to be an emergency and this Ordinance shall take effect from and after its passage and approval.

 

PASSED AND ADOPTED this 16th day of June, 1997.
