RESOLUTION OF THE CITY OF JONESBORO, ARKANSAS APPROVING THE CONTRACT WITH DERRICK BARTON TENNIS COURT CONSTRUCTION FOR CONSTRUCTION OF TENNIS COURTS AND LIGHTING AT ALLEN PARK UNDER THE 2001 AND 2002 STATE OF ARKANSAS DEPARTMENT OF PARKS AND TOURISM PROGRAM GRANT

WHEREAS, the City of Jonesboro advertised and received bids for the construction of tennis courts and lighting at Allen Park on September 12, 2003 for the Parks Grant Project with the State of Arkansas Department of Parks and Tourism; and
WHEREAS, the low bid of $655,000 was submitted by Derrick Barton Tennis Court Construction, which was checked by our Architect, Matt Silas Architect; and
WHEREAS, as a result of the bids were over our budget, we asked the contractor to give us a revised decrease in his bid but maintain the overall quality of the tennis courts, resulting in a negotiation of a savings of $100,350.00 which would give us a proposed contract price of $554,650.00; and
WHEREAS, the Parks Committee recommended on September 24, 2003 approval of awarding a contract to the low bidder and then accept a negotiated contract for $554,650.00.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:
THAT, the low bid be accepted and further agreed to the negotiated proposed contract price of $554,650.00 with Derrick Barton Tennis Court Construction, as set out in the documents attached hereto, and is hereby approved; and that the Mayor and City Clerk be authorized to sign the contract.
