AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF A GRADALL XL3300 HYDRAULIC EXCAVATOR WITH GRAPPLE ATTACHMENT

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS THAT:
SECTION 1: That the City of Jonesboro Street Department needs to purchase a 2008 GRADALL XL3300 HYDRAULIC EXCAVATOR.
SECTION 2: That said excavator can be obtained from Scott Construction Equipment Co., 10923 West Interstate 30, Little Rock, AR 72209, at a cost of $223,200.00. Price includes delivery to Jonesboro.
SECTION 3: That the Gradall XL3300 hydraulic excavator best meets the needs of the Street Department and the Public Works Committee recommends the purchase of said excavator.
SECTION 4: That money for the purchase of said excavator shall be appropriated from the Street Department Fixed Asset account 02-100-0232-00.
SECTION 5: That the City Council in accord with the terms of A.C.A. Section 14-58-302 hereby waives the requirement of competitive bidding and directs the Purchasing Officer to purchase the above described services for the price set forth in Section 2 above.
SECTION 6: It is further found that due to the immediate need to acquire these services an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health, and safety shall take effect from and after its passage and approval.
