AN ORDINANCE TO VACATE AND ABANDON UTILITY EASEMENTS IN THE WEST BRANCH COMMERCIAL ADDITION JONESBORO, ARKANSAS

BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas, that:
SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to the utility easements shown on the West Branch Commercial Addition, Jonesboro, Arkansas, as shown by plat recorded in plat Cabinet B at page 98 in the office of the Circuit Clerk for the Western District of Craighead County in Jonesboro, Arkansas.
SECTION 2: A copy of the Ordinance certified by the City Clerk shall be filed in the office of the recorder of the Craighead County, Arkansas and shall be filed in the deed records of such office.
SECTION 3: The City Council of the City of Jonesboro, Arkansas finds and declares that the above utility easements are not necessary for the general benefit and welfare of the public; that the owners of all the property abutting the above utility easements are in favor of the closure and vacation of the above utility easements and that therefore an emergency is declared to exist and this Ordinance shall take effect and be in full force from and after its passage and approval.
