AN ORDINANCE REPEALING ORDINANCE NO.710 OF THE ORDINANCES OF THE CITY OF JONESBORO, ARKANSAS, ADOPTED MAY 4, 1942, AND PERTAINING TO THE LICENSING OF GASOLINE PUMPS NOT USED IN RETAIL TRADE, AND FOR OTHER PURPOSES

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
SECTION 1: That ordinance No.710 of the ordinances of the City of Jonesboro, Arkansas, adopted May 4, 1942, and pertaining to the licensing of gasoline pumps not used in retail trade, be, and it is hereby repealed.
SECTION 2: It is found and declared that said ordinance No.710, adopted May 4, 1942, is a revenue measure, instead of a regulatory measure, and that, as a revenue measure, it was and is unauthorized by law; that it is discriminatory against those using individual gasoline pumps in their own businesses for their own convenience; that the subject of said ordinance is adequately covered and governed by other currently effective ordinances; that the preservation of the public peace, health and safety requires the immediate repeal of said ordinance No.710; and that, therefore, an emergency is hereby declared to exist, and this ordinance shall take effect and be in full force from and after its adoption.
