AN ORDINANCE TO AMEND ORDINANCE NO. 1034 SAME BEING AN ORDINANCE PRESCRIBING ADDITIONAL RULES FOR THE LOCATION OF BUILDINGS HEREAFTER ERECTED, CONSTRUCTED, RE-CONSTRUCTED OR ALTERED ALONG CERTAIN STREETS AND DESIGNATED LINES IN OR ADJACENT TO THE CITY OF JONESBORO, ARKANSAS

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: Section 2, C (a) of Ordinance No. 1034 is hereby repealed.

 

Section 2: Section 2 (b) is hereby amended to include sub-section (21) as follows:

 

Caraway Road and as extended from Johnson Avenue South to the Southeast corner of Section 29, Township 14 North, Range 4 East.

 

Section 3: This ordinance shall not repeal this or any other ordinance of the City of Jonesboro except as set forth herein, but the provisions herein shall be cumulative with and to such other laws or ordinances.

 

Section 4: Any person, persons, corporations or owners of lands, or persons constructing, erecting, re-constructing or altering any building or maintaining any such structure which has been constructed, erected, re-constructed or altered since the passage of this ordinance closer or nearer to the centerline of the street than is permitted by this ordinance, shall be guilty of a misdemeanor and on conviction thereof shall be fined not less than $25.00 nor more than $100.00 and each day’s violation shall constitute a separate misdemeanor and be subjects to the same fine and punishment.

 

Section 5: It is found and declared by the City Council that this ordinance being necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist and this ordinance shall take effect from and after its passage and approval.
