WHEREAS, SB 585 sponsored by Senator Kennedy and Hoofman, the “Electric consumer Choice Act of 1999" contains terms and provisions protecting municipally owned electric utilities systems; and

WHEREAS, SB 585, the proposed “Electric consumer Choice Act of 1999", comprehensively deals with many issues associated with electric utility industry restructuring; and

WHEREAS, SB 585, the “Electric consumer Choice Act of 1999", is supported by diverse utility and consumer groups in the State of Arkansas, and

WHEREAS, SB 661, a competing version of electric utility restructuring legislation prepared by rural electric cooperatives delays implementation of customer choice, disenfranchises citizens of cities owning electric systems, imposes unneeded and unwanted regulatory burdens on municipal electric systems, hampers the growth of cities in Arkansas, focuses on issues irrelevant to the restructuring of the electric utility industry, and is patently unlawful by retroactively locking in electric service areas;

WHEREAS, HB 1707, “Electrical Restructuring”, effectively freezes the growth of municipal electric systems for a period of two years, thereby effectively damaging the growth of cities.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Jonesboro, Arkansas:

SECTION 1: This Resolution shall be the formal advise and recommendation to the Arkansas General Assembly for passage of SB 585 the “Electric consumer Choice Act of 1999", and opposition to SB 661 and HB 1707 by the City Council of the City of Jonesboro, Arkansas.
