AN ORDINANCE TO WAIVE COMPETITIVE BIDDING TO PURCHASE GOODS AND SERVICES FROM TEMPLE, INC. FOR THE IMPLEMENTATION OF TRAFFIC SIGNAL COMMUNICATIONS IMPROVEMENTS AND DECLARING AN EMERGENCY FOR THE PURPOSE OF EXPEDITING THE IMPLEMENTATION OF THE PLAN TO IMPROVE TRAFFIC SIGNAL COMMUNICATIONS

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS THAT:
SECTION 1:  That the City of Jonesboro purchased traffic control software from Temple, Inc. under a sole source contract.
SECTION 2.  That the City of Jonesboro entered in to a separate agreement with Temple, Inc. to develop a plan to fix communication issues with 20 or so signals.
SECTION 3.  That the City of Jonesboro shall purchase goods and services (described in the attached quote) from Temple, Inc. for implementation of their plan for communication improvements for the sum of $28,201.63 + tax. That said sum shall be paid from the Energy Efficiency and Conservation Block Grant; at no cost to the City of Jonesboro.
SECTION 4.  That the City Council in accordance with the terms of A.C.A. Section 14-58-302 hereby waives the requirement of competitive bidding and directs the Purchasing Agent to issue a purchase order for the above described for the price set forth in Section 3 above.
SECTION 5:  It is further found that due to the immediate need to expedite the implementation of the plan to improve traffic signal communications, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage and approval.
 
PASSED AND ADOPTED this 21st day of August, 2012.
