AN ORDINANCE REQUIRING A DUPLICATE OATH OF OFFICE BE FILED WITH THE OFFICE OF CITY CLERK, AND NAMING THE CITY CLERK AS THE KEEPER OF CITY BOARD AND COMMISSION RECORDS

WHEREAS, it is the desire of the Jonesboro City Council to properly maintain complete and accurate records of all City Boards and Commissions; and

WHEREAS, board members & commissioners are required through the provisions of Arkansas Code Annotated 21-2-105 as well as other state laws to take the Oath of Office, having it administered by the appropriate officer; and

WHEREAS, the Nominating and Rules Committee reviewed this ordinance on December 14, 2004 and recommended its placement on the December 20th agenda.

NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

SECTION1: The Office of City Clerk of Jonesboro, Arkansas shall be the keeper of all city board and commission records, including but not limited to the Oath of Office.

SECTION 2: Within fifteen (15) days after a board member or commissioner has been approved the appointee shall forward a duplicate oath to the Office of City Clerk to be recorded and filed in his or her office as provided in Attachment (A).

SECTION 3: In case any appointee shall fail or neglect to apply for or procure his or her Oath of Office, or shall, after the commission has been obtained, fail or neglect to forward to the Office of City Clerk his or her duplicate oath for recordation in that office, with the time specified in Section 2 above, then the office to which that person was commissioned shall be deemed vacant.

SECTION 4: The City Council, on being satisfied from the official records of the Office of City Clerk, by reason of any of the causes enumerated in Section 2 above, shall proceed to fill the vacancy in the manner provided by law.

SECTION 5: The Mayor or City Council committee recommending a person for appointment to a city board or commission shall submit a resolution containing the appointee’s name, ...
