AN ORDINANCE TO VACATE AND ABANDON TEASDALE DRIVE, LOCATED WITHIN THE CITY OF JONESBORO, ARKANSAS

WHEREAS, a Petition was duly filed with the City Council of the City of Jonesboro, Arkansas, on the 7th day of January, 1980, asking the City Council to vacate and abandon all that portion of the street designated on the Plat of the Teasdale Acres Addition to said City, now appearing on record in Deed Record Book 123 at Page 5, in the office of the Recorder of Craighead County, Arkansas. A copy of the Plat is attached hereto and made a part hereof.
 
WHEREAS, after due notice as required by law, the Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the street, hereinabove described, has heretofore been dedicated to the public use as a street herein described, has not been actually used by the public since the filing of the Plat; that all the owners of the property abutting the street sought to be vacated have filed with the Council their written consent to such abandonment; and that public interest and welfare will not be adversely effected by the abandonment of the street.
 
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
 
Section 1: The City Council of Jonesboro, Arkansas, hereby release, vacates and abandons all its rights, together with the right of the public general, in and to the street known as Teasdale Drive which is shown on the Plat attached hereto and made a part hereof, subject to easements being given to City Water & Light and Ark La Gas Company.
 
Section 2: A copy of the Ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of the County and recorded in the Deed Records of the County.
 
Section 3: This ordinance shall take effect and be in force from and after its passage and approval.
 
PASSED and ADOPTED this 21st day of January, 1980.
