BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF JONESBORO, ARKANSAS:

SECTION 1. That Ordinance No. 789 of the ordinances of the City of Jonesboro, Arkansas, be amended as follows:

That paragraph reading “City Engineer Fred Hayward will be in charge of deciding the classification under which the various business houses come” is hereby stricken and deleted.

SECTION 2. That in lieu of said paragraph hereinabove deleted the following words shall be inserted “That the City Council hereby authorizes and empowers the Mayor of the City of Jonesboro to classify and reclassify the various business subscribers to the City Garbage Department. That said classification and reclassification shall be made upon the basis of the approximate actual cost incurred by the city in furnishing service to said classified or reclassified firms or businesses. That every said business firm shall be placed in its appropriate classification as scheduled hereinabove after the appropriate classification has been determined in accordance with the cost formula as set out herein.”

SECTION 3. Whereas, it is apparent that the City Garbage Collection Department is incurring a larger monthly deficit by reason of improper classification and inadequate fees and whereas the Council hereby finds that the City is not financially able to operate said Collection Department at a loss and whereas the uninterrupted operation of said department is necessary to prevent the spread of disease in the city and to maintain cleanliness and the immediate passage and enforcement of this ordinance being necessary to protect peace, health and safety; an emergency is therefore hereby declared to exist and this ordinance shall be in full force and effect from and after its passage, adoption and publication.
