APPEAL HEARING - 5:45 P.M. - An appeal hearing was held regarding denial by the Metropolitan Area Planning Commission to rezone property from Residential (R-1) to Commercial (C-3), located on Stadium Boulevard south of Bunting Drive. Mr. Terry L. Henson requested the hearing, and addressed Council first. Mr. Henson stated he realized it was a small piece of property and that residential zoning surrounded it, but explained the property was annexed in as residential. He stated he was hopeful that this would encourage others in the area to rezone their non-conforming property. He stated he had a letter signed by all but one of his neighbors agreeing the property should be zoned Commercial (C-3). Mayor Brodell questioned the size of the lot. Mr. Henson responded that it was a little over a third of an acre (167 X 93 feet). The question was asked of City Planner, Jeff Hawkins, why did the MAPC recommend denial. Mr. Hawkins stated generally the MAPC felt the property was more suited for commercial purposes than residential purposes, but there should be a more comprehensive approach to determining zoning boundaries, than one non-conforming piece at a time. Mr. Henson stated there were several non-conforming properties operating as commercial in the immediate area.

PUBLIC HEARING - 6:05 P.M. - A public hearing was held for the purpose of vacating a portion of Marchbanks Circle and certain utility easements. Mr. Rick Wyatt stated he had been denied access to the property by the Highway Commission, and so the abandonment was necessary. Questions followed regarding the utility letters. Mr. Wyatt explained that the only letter not received was Southwestern Bell. City Clerk, Donna K. Jackson stated the only letter she had been provided was for Cox Communications. She requested copies of the letters be sent to her so they could be provided to Council.
