AN ORDINANCE TO VACATE AND ABANDON A PORTION OF BELMONT AVENUE IN THE CITY OF JONESBORO, ARKANSAS

WHEREAS, a petition was duly filed with the City Clerk of the City of Jonesboro, Arkansas, on June 5, 1967, asking the City Council to vacate and abandon all that portion of Belmont Avenue between Madison Street and where it dead ends against Lot 13 of Block 8 Ridgecrest Addition as here in below more particularly described, and as same appears on the plat in Deed Record book #48 at pages 115 and 134 in the office of the Circuit Court Clerk and Recorder at Jonesboro, Arkansas described as follows, to-wit:
That portion of Belmont Avenue commencing with the west line of Madison Street and extending west for a distance of approximately 161 feet where it dead ends against Lot 13 in Block 8 of Ridgecrest Addition to Jonesboro, Arkansas.
WHEREAS, after due notice as required by law, the City Council has at the time and place mentioned in the said notice, heard all persons desiring to be heard on the question and has ascertained that that portion of Belmond Avenue here in above described has here to fore been dedicated to the public uses; and that same has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat of said Addition with one exception, to-wit: The City Water & Light Plant has run a sewer line East and West along the center line of that portion of Belmont Avenue sought to be abandoned and closed, and a permanent easement in favor of said City Water & Light Plant should be reserved Seven and one-half feet (7 ½ ) on either side of said center line where said sewer pipe is located, and that all of the owners of property abutting to that portion of Belmond Avenue to be vacated have filed with the City Council their written consent to such abandonment; and that the public interest and welfare will not be adversely affected by said abandonment, subject to the above easement.
