RESOLUTION TO SET A PUBLIC HEARING TO ABANDON A RIGHT OF WAY ON PEABODY DRIVE AS REQUESTED BY CARLOS WOOD

WHEREAS, the property owners have filed a petition with the City Clerk of Jonesboro, Arkansas, requesting that the east 0.16 acres of Peabody Drive right-of-way in a part of the Southwest Quarter of the Northeast Quarter of Section 33, Township 14 North, Range 4 East, Craighead County, Arkansas, and being more particularly described as follows:
Commencing at the Southeast corner of the Southwest Quarter of the Northeast Quarter of said Section 33(same being the Southeast corner of Lot 5 of a Replat of Lot 3 of Calvary Chapel Addition); thence North 0°13'44" West 198.32 feet to the point of beginning proper; thence South 88°43'40" West 126.09 feet; thence along a curve to the left having a Delta of 67°58'01" and a length of 65.24 feet; thence North 88°43'40" East 113.71 feet; thence South 0°13'44" East 60.00 feet to the point of beginning proper, containing 0.16 acres more or less.
Be abandoned; AND
WHEREAS, the petition has been presented to the City Council of the City of Jonesboro, Arkansas; AND
WHEREAS, Arkansas Statute Annotated 19-3814 requires a two week public notice before the above street right of way can be vacated and abandoned.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Jonesboro, Arkansas, that the City Clerk is directed to publish a notice once a week for two consecutive weeks advising the public of the request by the property owners to vacate and abandon the unimproved said street right of way and this matter will be heard before the City Council on September 17, 2001 at 6:15 p.m. at City Council Chambers, 900 W. Monroe, Jonesboro, Arkansas.
