AN ORDINANCE TO APPROPRIATE MONIES AND ESTABLISH A RESERVE FUND FOR ABATEMENTS

WHEREAS, in the exercise of its obligations to the citizens of the City to enhance the quality of life and ensure public safety, the City of Jonesboro finds it necessary to engage in abatement proceedings to end nuisance and other adverse activities; and,

 

WHEREAS, these proceedings may result in the awarding of funds to be paid to the City to offset costs incurred, and for civil penalties; and,

 

WHEREAS, City was recently awarded $5,000.00 as a civil money penalty in an abatement proceeding, and there is a need to appropriate funds for the continuance of these abatement efforts; now therefore,

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS THAT:

 

SECTION 1: A reserve fund be established to earmark revenues and expenses related to future abatement proceedings, and accounts be established to designate revenues, expenses, and fund balances remaining at the end of each budgetary year.

 

SECTION 2: That the monies provided in the civil penalty award of $5,000.00 be earmarked and credited to the established revenue account from unappropriated general revenues.

 

SECTION 3: The 2010 Budget passed by the Council on December 14, 2009 be amended to reflect the above appropriation and proposed expenditure of the reserved monies.

 

SECTION 4: It being necessary that the finances of the City of Jonesboro, Arkansas be efficiently administered and accounted for, and whereas this ordinance is necessary for the proper execution of contractual obligations, an emergency is declared to exist and this ordinance shall be in full force and effect from and after its passage and approval.
