ORDINANCE TO VACATE AND ABANDON AN ALLEY RUNNING BETWEEN CULBERHOUSE AND OLIVE STREETS

WHEREAS, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas, on the 5th, day of May, 1969, praying the City Council to vacate and abandon an alley described as:
An alley 10 feet in width running East and West between Culberhouse Street and Olive Street in Block B of Nisbett Addition to the City of Jonesboro, Arkansas, platted and filed for record in the Recorder's office at Jonesboro, Arkansas, in Surveyor's Record at page .
WHEREAS, after due notice as required by law, the City Council has, at the time and place mentioned in the Notice, heard all persons desiring to be heard on the question and has ascertained that the alley or portion thereof, hereinbefore described, has heretofore been dedicated to the public use as an alley by the public; that the owners of the property abutting upon the portion of the alley to be vacated above filed with the City Council their written consent to such abandonment; and the public interest and welfare will not be adversely affected by the abandonment of such alley; that said alley is not now being used as an alley by the public.
NOW, THEREFORE, be it ordained by the City Council of the City of Jonesboro, Arkansas:
Section 1: The City of Jonesboro, Arkansas, hereby releases, vacated, and abandons all its rights, together with the rights of the public generally in and to the alley designated and described above.
Section 2: A copy of this Ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of the Jonesboro District of Craighead County and recorded in the deed records of said county.
Section 3: This Ordinance shall take effect from and after its passage.
