RESOLUTION TO SET A PUBLIC HEARING TO ABANDON AN ALLEY BETWEEN MAIN STREET AND CHURCH STREET

WHEREAS, property owners have filed a Petition with the City Clerk of the City of Jonesboro, Arkansas, requesting that a portion of an alley running between Washington Street and an abandoned East West alley between Main Street and Church Street be closed and abandoned.
WHERAS, the Petition has been presented to the City Council of the City of Jonesboro, Arkansas; and,
WHERAS, pursuant to Arkansas Code Annotated 14-300-112 and 14-54-104 the City Council has determined that the alley is not needed for highway purposes and that the public safety and welfare of the City will be enhanced or promoted by the closing and abandoning of said alley; and,
WHEREAS, the owners of the adjoining property, as well as other property owners and utility companies’ that have property or utilities within the Block where the alley requested to be closed is located do not object and consent to said closing; and,
WHEREAS, Arkansas Code Annotated 14-301-112 and 14-54-104 expressly grant and confer authority upon the City of Jonesboro to close and abandon an alley or portions thereof in this manner; and
WHEREAS, it is not determined and hereby declared that the closing of this portion of this alley is necessary for the immediate preservation of the public safety and welfare and an emergency is hereby declared and this resolution and the agreement it authorizes shall take effect from and after its passage.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Jonesboro, Arkansas, pursuant to Arkansas Code annotated 14-54-104 and 14-301-112, finds that the above described portion of the alley is not needed for Highway purposes and that the safety and welfare of the City will be enhanced or promoted by the closing and abandoning of said portion of the alley; and that the Mayor and City Clerk are authorized to join with the adjoining property owners in a written agreemen...
