AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF SPECIAL STREET SEALING WORK IN 1991 FOR THE CITY OF JONESBORO AND  FOR OTHER PURPOSES.

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

SECTION 1: That the Street Department needs to purchase the application of 15,000 gallons of CRF restorative seal with the contractor providing all materials (including necessary sand), equipment and labor to apply the materials where directed by the City in accordance with the manufacturing recommendations.

 

SECTION 2: That the City of Jonesboro shall be responsible for cleaning the street in advance of contract sealing and to provide traffic control during the sealing operation, with the contractor notifying the Public Works Director at least two (2) weeks prior to commencing the sealing operation. 

 

SECTION 3: That such street sealing work may be purchased from Pavement Recycling, Inc., 2541 Ranchito Street, Cape Girardeau, Missouri 63701, Howard E.  Metheny, President, for the sum of $51,500.00 total.

 

SECTION 4: That the City Council, in accord with the terms of A.C.A.  14-58-302 (2) (B)   Hereby waives the requirement of competitive bidding and directs the Purchasing Officer to the above described work for the price set forth in Section 2 above.  Said amount shall be paid by money from the Street Contracts line item in the Street Department budget.

 

SECTION 5: It is further found that Pavement Recycling, Inc., is the sole source of the  above repairs and that due to the immediate need to acquire these repairs, and emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect from and after its approval.
