AN ORDINANCE TO AMEND ORDINANCE NO. 2504 PROVIDING FOR A CHANGE IN THE AMOUNT OF RIGHT OF WAY RESERVED FOR EACH CLASS OF STREET REQUIRING ENGINEERING INFORMATION AND FOR OTHER PURPOSES.

BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF JONESBORO, ARKANSAS:

 

SECTION 1: That the City Council for the City of Jonesboro, Arkansas hereby amends Ordinance No. 2504, amending Sub-Section 5 thereof by adding the following language:

 

FURTHER, the Metropolitan Area Planning Commission may reserve less than the required right of way specified for the various classifications set out in Section Three if it deems it appropriate.  In making said decision, the MAPC may require the proponent of the change or variation to provide engineering designs covering roadway design, drainage design, and location of utilities and a topographic survey of the location of the proposed street.

 

SECTION 2: The rest and remainder of said Ordinance 2504 of the Jonesboro Code of ordinances, except as expressly amended herein, shall remain in full and force and effect.

 

SECTION 3: That the Ordinance as presently drafted unduly restricts development and the orderly growth of the City of Jonesboro, Arkansas.  Therefore, this Ordinance is necessary for the preservation of public peace, health and safety, there is hereby declared to be an emergency and this ordinance shall take effect from and after its passage and approval.
