AN ORDINANCE TO VACATE AND ABANDON AN UNIMPROVED PORTION OF MURRAY CREEK DRIVE (EASEMENT)

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:     
 
SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to the easements designated as follows:
 
LEGAL DESCRIPTION
 
The East 7.5 feet of Lot 47; and the South 15 feet of Lot 48; and the East 15 feet of the South 24.33 feet of Lot 48; and the South 15 feet of the East 78 feet of Lot 49; and the 15 foot easement lying East of the 50 foot drainage easement in Lots 49 and 50, all in the Murray Creek Subdivision, Phase III, Jonesboro, Arkansas as shown by plat recorded in Plat Cabinet B at page 93 in the office of the Circuit Clerk for the Western District of Craighead County in Jonesboro, Arkansas.
 
SECTION 2: A copy of the Ordinance certified by the City Clerk shall be filed in the office of the recorder of Craighead County, Arkansas and shall be filed in the deed records of such office.
 
SECTION 3: The City Council of the City of Jonesboro, Arkansas finds and declares that the above easements are not necessary for the general benefit and welfare of the public; that the owners of all the property abutting the above streets are in favor of the closure and vacation of the above street and that therefore an emergency is declared to exist and this ordinance shall take effect and be in full force from and after its passage and approval.
