AN ORDINANCE ABANDONING CERTAIN PROPERTY ADJACENT TO MATTHEWS AVENUE

WHEREAS, by survey plat for Medical Center Development Corporation Addition recorded October 26, 1979, the City of Jonesboro did acquire along the northern boundary of Lot 1 of said addition additional right-of-way on East Matthews Ave.; and
WHEREAS, said plat was approved by the Metropolitan Area Planning Commission;
WHEREAS, the additional right-of-way acquired did encroach upon an existing building located on a portion of said Lot 1 and the affected property owner has petitioned the Council for remedy of this encroachment and,
WHEREAS, said right-of-way as granted was in excess of that necessary for the public use and right-of-way in question; that a substantial part of the right-of-way shown on the plat has not been developed nor used by the public; and that the public interest and welfare will not be adversely affected by the abandonment of five feet of said right-of-way;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all its right, together with the right of the public generally in street right-of-way five (5) feet in width along the southern boundary of East Matthews Avenue adjacent to the northern boundary of the following part of Lot 1 of Medical Center Development Corporation Addition to Jonesboro, Arkansas, described as follows: That part intended to be re-platted as McKee’s Re-plat of a part of Lot 1 of Medical Center Development Corporation to the City of Jonesboro, described as follows; Commence at the North Quarter Section Corner of the Northeast Quarter of Section 19, Township 14 North, Range 14 East; thence South 0°3 minutes East 32.7 feet; thence North 88°28 minutes 57 seconds East 39.58 feet; thence South 0°11 minutes 42 seconds West 23.02 feet; thence North 89°1 minute 54 seconds East 10.99 feet to the point of beginning proper; thence N...
