RESOLUTION TO AUTHORIZE THE CITY ATTORNEY TO ATTEND ALL HEARINGS CONCERNING THE INCORPORATION OF THE TOWN OF “SHADY PARK” AND TO URGE THE CITIZENS OF SAID TOWN TO WITHDRAW THEIR REQUEST

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:
WHEREAS, a petition has been filed with the Craighead County Court by certain landowners in the “Shady Park” area West of Jonesboro, Arkansas, seeking to incorporate this certain area into an incorporated town to be known as “Shady Park;” and
WHEREAS, the Mayor has appointed a committee of aldermen of the City of Jonesboro to investigate into the request of the landowners and report their findings to the City Council; and
WHEREAS, the Mayor’s committee has reported to the Mayor and the Council that the incorporation of a town so near the borders of the city limits of Jonesboro will be detrimental to the City’s planning for the future growth in a westerly direction and will materially affect the jurisdiction of the Metropolitan Planning Commission.
NOW,THEREFORE, be it resolved by the City Council of Jonesboro, Arkansas, that the incorporation of the “Shady Park” town on the western edge of the city will be detrimental to the growth and prosperity of the citizens of the City of Jonesboro and to the residents in the proposed town, and the City Attorney is hereby authorized and directed to attend all hearings concerning the proposed incorporation of the town of “Shady Park” and urge the citizens in the area of the proposed town to withdraw their request and enter the objections of the City to such incorporation.
