AN ORDINANCE RE-CODIFYING CHAPTER 10.04.11 THROUGH 10.04.18 OF THE JONESBORO MUNICIPAL CODE, REGARDING CITY WATER REGULATIONS; REPEALING CHAPTERS 10.04.19 AND 10.04.20; AND DECLARING AN EMERGENCY

WHEREAS, Ordinance No. 3042, which among other things established rules and regulations for potable water cross-connection control, contained a provision which inadvertently placed the provisions thereof under Chapter 10.04 (Sewer Regulations) of the City Code; and

 

WHEREAS, it is the desire of the City Council that said provisions be more appropriately codified in a separate Chapter.

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

SECTION 1: That the provisions of Ordinance No. 3042, codified as Title 10, Chapters 10.04.11 through 10.04.18 of the Jonesboro Municipal Code shall be and are hereby removed from chapter 10.04, and re-codified in a new Chapter to be added and known as “Water System Backflow Prevention” and numbered as Title 10, Chapters 10.06.01 through 10.06.08.

 

SECTION 2: That Chapters 10.04.19 and 10.04.20 are hereby repealed.

 

SECTION 3: That the immediate re-codification of water regulations is hereby found and determined to be necessary in order to insure the preservation of the public health, safety, and welfare, therefore an emergency is hereby declared to exist, and this ordinance shall take full force and effect from and after the date of its passage and approval.
