RESOLUTION OF THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS, ESTABLISHING A MORATORIUM FOR APPLICATION FOR, CONSIDERATION OF OR APPROVAL OF R-2A OR R-3 REZONING CLASSIFICATION REQUESTS (NOTE: THIS MORATORIUM WAS EXTENDED BY RES-04:555 ON OCTOBER 4, 2004; RES-04:536 ON DECEMBER 6, 2004)

WHEREAS, the City of Jonesboro currently provides for both single-family and multi-family uses in the city's R-2A and R-3 zoning classifications; and
 
WHEREAS, the City Council of the City of Jonesboro has determined a need to more specifically define the city's zoning classifications by providing for separate single-family and multi-family zoning classifications; and
 
WHEREAS, the Metropolitan Area Planning Commission's consideration of proposed changes to the city's single-family and multi-family zoning classifications was postponed due to inadequate public notice procedures; and
 
WHEREAS, the City Council of the City of Jonesboro has determined that a need exists to provide adequate time for review, consideration and adoption of amendments to the city's zoning ordinance to provide for the separate single-family and multi-family zoning classifications.
 
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS THAT:
 
1.      A moratorium is hereby declared on the application for, consideration of or approval of R-2A or R-3 rezoning classification requests for a period not to exceed 90 days beginning on the date this resolution is passed.
 
2.      During this moratorium period, an ordinance or ordinances providing for separate single-family and multi-family zoning classifications without creating a taking of property rights by the city regarding property currently zoned R-2A or R-3 are to be prepared by city staff, reviewed by the Metropolitan Area Planning Commission and adopted by the City Council.
 
3.      This resolution shall take effect immediately.
