AN ORDINANCE TO LIMIT THE NUMBER OF DOMESTIC ANIMALS WHICH ANY ONE PERSON CAN KEEP AT ANY ONE TIME WITHIN THE CITY LIMITS OF THE CITY OF JONESBORO, ARKANSAS AND PRESCRIBING PENALTIES FOR VIOLATIONS THEREOF

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

Section 1: The following terms shall be defined as follows:

(a) Domestic animals when used herein shall include cats, water fowl, gallinaceous birds which include chickens, guinea, peafowl, pheasants, quail partridges and turkeys, goats, sheep, horses and cattle over three (3) months of age, both male and female. The burden of proof shall be on the owner to establish the age of the animals.
(b) Owner-every person, firm, corporation, association or household, when the parties reside on the same property, keeping or harboring a domestic animal within the corporation, association or household, when the parties reside on the same property, keeping or harboring a domestic animal within the corporate limits of the city.

Section 2: It shall be unlawful for any person to own or possess more than eight (8) domestic animals except cattle or horses, at any one time.

Section 3: It shall be unlawful for any owner to maintain horses and cows within the corporate limits of the City of Jonesboro within 150 feet of any residence, except that this section shall not apply to pasture lands which exceed two (2) acres or more in area.

Section 4: The Animal Control Officer shall be authorized to enforce this ordinance and shall issue a warning to an owner giving said owner to week’s notice to remove said violation before a warrant of arrest is issued.

Section 5: Pet Stores and Veterinary Hospitals shall be excluded from the provisions of this ordinance.

Section 6: Any person who violates any provision of this ordinance shall upon conviction be subject to a fine of not more than Five Hundred Dollars ($500.00) for each conviction.
