A RESOLUTION TO AMEND ORDINANCE 09:012, AN ORDINANCE TO ENTER INTO A CONTRACT FOR DEBRIS REMOVAL AND DISPOSAL RELATED TO THE WINTER ICE STORM

WHEREAS, the City of Jonesboro has entered into a contract with D & J Enterprises, Inc. for the removal and disposal of storm debris in the City of Jonesboro; and
WHEREAS, the contract declares that the contractor shall complete services in forty-five days upon issuance of the notice-to-proceed and not from the date that contract was signed; and
WHEREAS, an extension is desired to complete the removal and burning of winter ice storm debris;
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF JONESBORO, ARKANSAS THAT:
SECTION 1: The time frame for completion of the removal and burning of winter ice storm debris shall be extended from 45 days to 75 days from the date that the notice to proceed was signed causing the completion date to be May 9, 2009.
SECTION 2: The Mayor and the City Clerk are hereby authorized by the City Council for the City of Jonesboro to execute all documents necessary to effectuate this agreement.
