AN ORDINANCE TO AMEND ORDINANCE NO.954, SAME BEING AN ORDINANCE ESTABLISHING THE ZONING REGULATIONS, AND PROVIDING FOR THE ADMINISTRATION, ENFORCEMENT AND AMENDMENT THEREOF AND CREATING A BOARD OF ZONING ADJUSTMENT; PROVIDING A PENALTY FOR VIOLATION THEREOF, AND FOR OTHER PURPOSES

BE IT ORDAINED BY THE City Council of the City of Jonesboro, Arkansas:

 

SECTION 1: From and after the passage and adoption of this Ordinance, Ordinance No.954, passed and adopted April 21, 1958, shall be and is hereby amended by the addition of the following:

 

ARTICLE VIII VIOLATIONS: PENALTY.

 

SECTION 2: It shall be unlawful to use or occupy any building, structure or premises in violation of the terms of this Ordinance. Any person, firm or corporation, whether they be the owner, occupier or user of said premises, building or structure, who violates, disobeys, omits, neglects or refuses to comply with, or who resist the enforcement of any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in any sum not more than $25,00 for each offense, and a separate offense shall be deemed committed on each date during or on which a violation occurs or continues.

 

SECTION 3: EMERGENCY CLAUSE. It being found and determined by the City Council of the City of Jonesboro, Arkansas that Ordinance No.954 passed and adopted on April 21, 1958, as amended, failed and neglected to provide a penalty for violation of said Ordinance; therefore an emergency is hereby declared to exist, and this Ordinance being necessary for the immediate preservation and protection of the public health, peace and safety, this Ordinance shall be in full force and effect from and after its passage and adoption.

 

PASSED and ADOPTED this 6th day of April 1959.
