WHEREAS, the City of Jonesboro has previously identified the need to upgrade the underground storm water drainage piping located along Caraway Road north of the Johnson Avenue intersection in order to improve the drainage patterns of the watershed; and

WHEREAS, the City of Jonesboro has previously entered into a cost sharing agreement with Campus Crest Development for construction of said improvements; and

WHEREAS, the City of Jonesboro has been notified of increased project costs due to conflicts with existing utilities in the project area and/or due to additional work in the project area; and

WHEREAS, the City of Jonesboro anticipates a mutual benefit to the Citizens of Jonesboro and Campus Crest Development from the proposed improvements; and

WHEREAS, Campus Crest Development has agreed to post a bond for $75,000 as its portion of the total cost of the storm water drainage and/or water line improvements and to dismiss the Petition For Citation For Contempt and For Other Emergency Relief and the Order to Show Cause filed on August 18, 2008, at 2:20 p.m. against the City of Jonesboro and its agents in return for the issuance of certain certificates of occupancy as described in the following recital; and

WHEREAS, the City of Jonesboro has inspected 3 of the 4 remaining buildings of the Campus Crest Development and has agreed to provide certificates of occupancy for these 3 buildings on the morning of August 20, 2008; and

WHEREAS, the City of Jonesboro will conduct the inspection of the remaining building in a timely fashion upon notification or request for such inspection and will issue the certificate of occupancy (or a list of deficiencies until such time as the building is completed so that it complies with the applicable code or ot...
