ORDINANCE TO VACATE AND ABANDON THE SOUTH SIDE OF THE ALLEY IN THE 1000 BLOCK OF HUNTINGTON AVENUE BETWEEN WALNUT AND NESBITT STREETS

WHEREAS, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas, on the 19th day of March, 1973, praying the City Council to vacate and abandon the alley described as:
 
The South side of the Alley in the 1000 Block of Huntington Avenue between Walnut and Nesbitt Streets.
 
WHEREAS, after due notice as required by law, the City Council has at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the alley theretofore described has heretofore been dedicated to the public use as an alley; that it has never actually been developed or used by the public for many years; that the owner of all the property abutting upon the alley to be vacated has failed with the City Council his written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such alley.
 
NOW, THEREFORE, be it ordained by the City Council of Jonesboro, Arkansas:
      
Section 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all its rights together with the rights of the public generally in and to the alley described as follows:
 
The South side of the Alley in the 1000 Block of Huntington Avenue between Walnut and Nesbitt Streets.
 
Section 2: A copy of the Ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of the Jonesboro District of Craighead County and recorded in the deed records of said county.
 
Section 3: This Ordinance shall take effect and be in force from and after its passage.
 
PASSED and ADOPTED this 21st day of May, 1973.
