RESOLUTION TO MAKE POLICIES TO BE ELIGIBLE FOR THE MODIFIED OVERTIME EXEMPTION UNDER THE FAIR LABOR STANDARDS ACT

WHEREAS, the City of Jonesboro is desirous of compliance with the Fair Labor Standards Act, and,

 

WHEREAS, the City of Jonesboro wishes to take advantage of the modified overtime exemption, and,

 

WHEREAS, it is the intention of the City of Jonesboro to make all necessary declarations and policies to be eligible for the modified overtime exemption under Fair Labor Standards Act, and,

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Jonesboro, Arkansas that:

 

(1)  Beginning January 1, 1975, the work period for fire-fighting personnel shall be 21 days. Shifts shall continue with 24 hours on duty and 48 hours off duty. Firefighting personnel shall be paid time and one-half for those hours worked over 181 hours within the 21 - day declared work period.

 

(2)  Beginning January 1, 1975, the work period for the policemen of Jonesboro, Arkansas, shall be 40 hours per seven-day work period. All policemen will be paid time and one-half for hours worked over 40 hours within the seven-day work period.

 

(3)  Administrative, professional and executive employees who meet the tests outlined in CFR 516 are excluded from coverage of both the minimum wage and maximum hours’ provisions of the Fair Labor Standards Act.

 

(4)  All city employees shall be paid on an hourly rate. All work periods not otherwise specified or excluded shall be for a seven-day work period beginning each Friday. All employees shall be except those exempt under CFR 516 and firefighters shall be paid time and one-half for hours worked over 40 hours per seven-day work period.
