RESOLUTION OF THE CITY OF JONEBORO, ARKANSAS COMMITTING FUNDS TOWARD COMPLETION OF THE ARKANSAS STATE UNIVERSITY WESTSIDE OVERPASS PROJECT.

WHEREAS, the City of Jonesboro, in response to a request by Arkansas State University, approves the commitment of $1,000,000 toward the completion of the Arkansas State University Westside Overpass Project subject to the following conditions:

A. Marshall Estates and Roland Street have a drainage condition that requires a physical repair. This project was not a part of the original scope for the design of the Arkansas State University Westside Overpass nor the responsibility of the University to repair; however, Arkansas State University will seek approval of the Arkansas Highway and Transportation Department to include as add alternate number one the inclusion of the Marshall Estates drainage pip and erosion control construction. The design to be directed by the City of Jonesboro;
B. Arkansas State University’s engineering consultant, Carter and Burgess, certifies that the detention pond currently designed to be built at the relocated intersection of Matthews and Washington as an integral part of the Westside Overpass Project will be sufficient to receive the runoff from the Marshall Estates property through the proposed drainage pipe based on information, such as flows and velocities for the pipe, previously provided;
C. Carter and Burgess certifies that as part of the original design, the existing bridges on Caraway Road will be removed and no significant impact to the water surface elevation upstream or downstream will result from this demolition;
D. If the original scope of the project may be paid for within the May 2005 total project estimate of $17,214,218 and additional uncommitted funds within the $17,214,218 are available that they will be allocated towards add alternate number one before any additional changes or add alternates occur; and
