ORDINANCE PROVIDING FOR THE APPOINTMENT OF CITY TREASURER FOR THE CITY OF JONESBORO AND FOR OTHER PURPOSES.

WHEREAS, Arkansas Code Annotated § 14-43-405 provides that a city of first class with a mayor-council form of government may provide for the appointment of its city treasurer for a four-year term;
WHEREAS, A.C.A. § 14-43-303 provides that the city treasurer’s four-year term shall coincide with the city attorney’s four-year term;
WHEREAS, the City Council adopted Ordinance No. 3076 in 1998 and Ordinance No. 3211 in 2000 both appointing the city treasurer to a two-year term with the term of the last ordinance expiring on December 31, 2002;
WHEREAS, it is the desire of the City Council to appoint a city treasurer to a four-year term retroactive to January 1, 2003 and expiring on December 31, 2006.
NOW THEREFORE BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas:
SECTION 1: The City Council of the City of Jonesboro hereby appoints Larry Flowers, the city’s Finance Director, as City Treasurer;
SECTION 2: The duties of said position shall be those as specified by A.C.A. § 14-43-507, § 14-59-115, any other relevant state laws and any and all ordinances related to the office of City Treasurer;
SECTION 3: The City Council reserves the right to replace the City Treasurer during his term at such time that he no longer serves in the position of Finance Director of the City of Jonesboro;
SECTION 4: The City Council of the City of Jonesboro hereby elects to keep this position under the City of Jonesboro’s non-uniformed employee pension plan, and specifically rejects the provisions of A.C.A. § 24-12-125.
SECTION 5: The term of this appointment shall be from January 1, 2003 to December 31, 2006;
SECTION 6: There being an immediate need for clarification on this position, to provide for the orderly and proper administration of the government for the City of Jonesboro, an emergency is declared to exist and this ordinance being nece...
