AN ORDINANCE TO VACATE AN ALLEY; AND FOR OTHER PURPOSES

WHEREAS, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas on the 16th day of August, 1982 requesting the City Council to vacate and abandon all that portion of an alley described as follows:
Alongside the South boundary of Lots #4 and #5 of Block J of Nesbitt’s First Addition to the City of Jonesboro, Arkansas.
WHEREAS, after due notice as required by law, the City Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the alley hereinbefore described, has heretofore been dedicated to the public use as an alley herein described; has not been actually used by the public generally for a period of at least five years subsequent to the filing of the petition; that all the owners of the property abutting upon the portion of the alley to be vacated have filed with the Council their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such alley.
Now, therefore, be it ordained by the City Council of the City of Jonesboro, Arkansas:
Section 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the alley described as follows:
Alongside the South boundary of Lots #4 and #5 of Block J of Nesbitt’s First Addition to the City of Jonesboro, Arkansas.
Section 2: A copy of this ordinance duly certified by the city Clerk shall be filed in the office of the recorder of the county and recorded in the deed records of the county.
Section 3: The abutting property owners to the east and west of the area abandoned and closed herein shall immediately make a formal dedication of all utility easements within said alley due to respective utility.
