AN ORDINANCE TO CLOSE A PORTION OF BERRY STREET A/K/A SHORT STREET RUNNING EAST AND WEST BETWEEN FRENCH STREET AND CARTWRIGHT STREET

NOW, THEREFORE, BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas, that:
 
Section One: The City Council finds that Berry Street a/k/a Short Street running east and west between French Street and Cartwright Street has never been opened to the public.
 
Section Two: The City Council finds that Berry Street a/k/a Short Street running east and west between French Street and Cartwright Street is not needed for public purpose now or in the foreseeable future.
 
Section Three: The City Council pursuant to Ark. Stat. Ann. ยง19-2304 (Repl. 1980) abandons and vacates Berry Street a/k/a Short Street between French Street and Cartwright Street and such property shall inure to the abutting property owners to the Centerline of Berry Street a/k/a Short Street, as recorded in Deed Record 48, P 212.
 
NOW, THEREFORE, the City Council for the City of Jonesboro, Arkansas does vacate and abandon Berry Street a/k/a Short Street running east and west between French Street and Cartwright Street and further, the City Council finds that an emergency exists and this ordinance is necessary for the protection and promotion of the public health, welfare and safety, that this ordinance shall take effect from and after its passage and approval.
