AN ORDINANCE TO VACATE AND ABANDON UTILITY EASEMENTS

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
SECTION ONE: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to the utility easement designated as follows:
LEGAL DESCRIPTION
All of the north ten feet (10') of Lot 4R and all of the south ten feet (10') of Lot 2R and all of the south ten feet (10') of Lot 5 and the north ten feet (10') of the west 75.38 feet of Lot 2R adjacent thereto as shown on the Replat of Lot 2 and Lot 3A of the Thomas Addition, Phase Two, Jonesboro, Arkansas, as shown by Plat recorded in the Plat Cabinet Bat Page 137 in the office of the Circuit Clerk for the Western District of Craighead County in Jonesboro, Arkansas.
SECTION TWO: A copy of the ordinance certified by the City Clerk shall be filed in the office of the Recorder of Craighead County, Arkansas and shall be filed in the deed records of such office.
SECTION THREE: The City Council of the City of Jonesboro, Arkansas finds and declares that the above utility easements not necessary for the general benefit and welfare of the public; that the owners of all the property abutting the above drainage easement is in favor of the closure and vacation of the above drainage easement and that therefore an emergency is declared to exist and this ordinance shall take effect and be in full force from and after its passage and approval.
