Public hearing 5:00 p.m.

The public hearing was called to order by Mayor Brodell at 5:00 p.m. a full quorum was in attendance. Present were Mayor Brodell, Philip Crego, City Attorney and Bryan Wadley for City Clerk Donna Jackson who was ill. 10 council members were present for public hearing including: Hannah, Province, Evans, Wise, Vance, Harpole, Roddy, Perrin, Kelton, Rega.

Mr. Ralph Waddell spoke first for the Fair Board requesting rezoning. Mr. Waddell stated that it appeared that the outcome had already been decided. According to newspaper, seven to eight have stated before the hearing how they will vote.

He felt that C-3 Zoning is inevitable on a four lane, soon to be Five Lane Road. Hwy. 49 North, making this site the best site for the fair. The question has now been raised by council on whether or not the fair can even locate in C-3 Zoning.

The Fair Board is all volunteer; the board is made up of Jaycees and Farm Bureau. Most uses are not charged for. Practically all are for non-profit groups, it is used approximately one third of the year. Fairs throughout the state are located in residential neighborhoods in Clay, Greene, Lawrence, Sebastian, and State Fairgrounds are just to name a few. Fourteen sites were submitted. Traffic can be handled according to Ernie Peters. All are Zoned R-1, some not for sale, some property owners did not know the property had been submitted.

3 ALTERNATIVES WERE DISCUSSED:
1. To stay where they are presently
2. To find another site meeting the criteria
3. To dissolve the Fair Association, withdraw Jaycees, withdraw Farm Bureau and let some other association have the fair.

The land was not zoned when Wheeler Heights purchased lots so there was not any R-1 Zoning in place prior to the 1989 annexation.

Mr. Curt Huckaby spoke for the unfair group at 5:24 p.m.
