Whereas, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas, on February 1st, 1971, asking the City Council to vacate and abandon all that portion of Mockingbird Lane in Marlo Acres, second Addition, to the City of Jonesboro, Arkansas, lying south of a line extending from the Southeast corner of Lot 9 of said Addition to the east right-of-way line of Mockingbird Lane as that street was laid out on the plat of Marlow Acres, Second Addition filed for record April 21, 1965, and appearing in Plat Deed Record 158 at page 1 in the records of the Recorder’s Office at Jonesboro, Arkansas; and

Whereas, after due notice as required by law, the Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the portion of Mockingbird Lane sought to be abandoned no longer adequately serves the southern portion of Marlo acres, Second Addition, because of the taking of a portion of said Addition by the Arkansas Highway Department as right-of-way for U.S. Highway 3 By-pass; and

Whereas, all of the owners of property abutting upon the portion of Mockingbird Lane sought to be abandoned and vacated have joined in said petition seeking the abandonment; and that public interest and welfare will not be adversely affected by the abandonment of that portion of Mockingbird Lane sought to be abandoned.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

Section 1: The City of Jonesboro hereby releases, vacates and abandons all its right, together with the rights of the public generally in and to a street designated as follows:
