ORDINANCE TO AMEND ORDINANCE NO. 3658 OF THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS, EXTENDING A MORATORIUM FOR ENFORCEMENT OF THE STORMWATER MANAGEMENT DRAINAGE ORDINANCE

WHEREAS, the City Council of the City of Jonesboro adopted Ordinance No. 3658, providing for a moratorium for enforcement of the Stormwater management drainage  ordinance  at its regular meeting on August 15, 2006; and

 

WHEREAS, the City Council of the City of Jonesboro has determined that there is a need for further review of the requirements of this Ordinance; and

 

WHEREAS, the public needs additional time to become familiar with and to implement requirements of this Ordinance without negatively impacting economic growth and development.

 

NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:   

 

SECTION 1: Ordinance No. 3658 is hereby amended, extending the moratorium on the enforcement of the penalty section of the Stormwater Management Drainage Ordinance for a period ending on December 31, 2006.

 

SECTION 2: During this extension of the moratorium period, the city staff is to review all applications required under the Stormwater Management Drainage Ordinance or in the absence of an application, the city staff is to request the submission of an application required under the Ordinance, but the staff is directed not enforce the penalty clause under Article 6 - Enforcement or to deter economic development as a result of any other article within the Ordinance.

 

SECTION 3: City staff shall prepare a report of all complaints related to the Stormwater Management Drainage Ordinance and present said report to the Stormwater Compliance Committee.

 

SECTION 4: Due to the need to maintain and protect the general welfare, an emergency is declared and this Ordinance shall be in full force and effect immediately upon its passage and approval.
