AN ORDINANCE TO VACATE AND ABANDON A PORTION OF NEIL CIRCLE

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
 
SECTION 1:   The City of Jonesboro, Arkansas, hereby releases, vacates  and abandons all of its rights, together with the rights of the public generally,  in and to a portion of the street known as Neil Circle as shown on the attached plat marked Exhibit "A" which is incorporated herein.  The portion to be abandoned being described as: (by Acro Woods, Inc Von Pausch, end of Neil Cr., comes off Neil Dr on E. Matthews Rd. - cut-off to Airport - C.  Frierson)
 
Begin at the intersection of the centerline of Neil Circle and the North R/W line of Neil Drive; thence N 29°02' W - 386.00'; thence N 43°18' W 104.10'; thence N 80°10' 13" W 50.00' to the point of  beginning proper; thence N 43°18' W 52.2' to the P. C. of a curve right whose radius = 57.5' ( Delta = 293°58' 04");  thence along said curve 293.97' to the P. T.  Of said curve; thence S 43°18' E 70.26' to a point on a curve whose radius = 50.00' (Delta = 73°44'25"); thence Westerly along said curve 64.35' to the point of beginning proper.
 
SECTION 2:   A copy of the ordinance, duly certified by the City Clerk, shall be filed in the offices of the Recorder of Craighead County, Arkansas.
 
SECTION 3:   It is found and determined by the City Council of the City of Jonesboro, Arkansas, that expansion plans of an existing industry are dependent upon the abandonment of   this small portion of Neil Circle and all property owners adjacent to the portion being abandoned  are in favor of such abandonment and that therefore an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect from and after its passage and approval.
 
PASSED AND ADOPTED this 21st day of August, 1989.
