AN ORDINANCE AMENDING ORDINANCES 900 AND 1034 BY PROVIDING FOR WAIVER OF SETBACK REQUIREMENTS

BE IT ORDAINED by the City Council of the City of Jonesboro:

 

Section 1: This Ordinance is adopted on recommendation of the City Planning Commission and as an amendment to the Master Street Plan and Ordinance 900 and 1034 and adopted pursuant to provisions of the laws of Arkansas relating to City Planning.

 

Section 2: The City Planning Commission or the City Council may waive the setback provisions of Ordinances 900 and 1034 in any location.

 

Section 3: WHEREAS, recommendations of right-of-way width have been received by the Council from the City Planning Commission pursuant to plans and studies of planning agencies, and ordinances have been adopted according to such recommendation, and the planning Commission and the City Council have been resented with a detailed recommendation prepared or approved by the State Highway Department, University of Arkansas, United States Bureau of Roads, and others, which stipulates different, and in some places less, right-of-way than the earlier ordinances require than the earlier ordinances require. Strict compliance with the original ordinances would deter building of improvements, drainage, and improvement of streets, and therefore adversely affect public peace, health and safety.

 

It is, therefore, declared that an emergency exists, and this Ordinance is necessary for preservation of the public peace, health and safety, and shall be in full force and effect from and after its adoption.
