AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF CONCRETE BOX CULVERT

BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas that:
SECTION 1: That the Street Department of the City of Jonesboro, Arkansas needs to purchase the following: Flowable Fill; 15 Ton Crane Rental; 60 LF of 12 X 8 concrete box culvert for the emergency replacement of Valley View Drive, between Valley View School and Thompson Road, Main Ditch # 2.
SECTION 2: That said equipment and supplies may be purchased from Nettleton Concrete for flowable fill (yearly bid) at $4,637.60; 15 Ton Crane from Cloinger Crane Rental for a two day rental at $2,400; and Scurlock Industries for the concrete culvert at $18,300.00 for a total of $25, 337.60 to be paid from the Drainage Fund as appropriated in the 2003 Budget.
SECTION 3: That the City Council in accord with the terms of A.C.A. Section 14-58-302 hereby waives the requirement of competitive bidding and directs the Purchasing Agent to purchase the above described for the price set forth in Section 2 above.
SECTION 4: It is further found that due to immediate need to prevent traffic and road hazards in the immediate area an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect from and after its passage and approval.
