Minutes for the City Council meeting on May 5, 2003

Public Hearing - 6:15 p.m. -A public hearing was conducted for the purpose of vacating a fifteen-foot (15’) sewer easement located off Parker Road near Higginbottom Creek. Farmer Enterprises, Inc. requested the abandonment for Home Depot. Councilman Farmer recused himself from the public hearing proceedings. No opposition was voiced.

 

CITY COUNCIL MINUTES - May 5, 2003

 

The Jonesboro City Council met Monday, May 5, 2003, at 6:30 p.m. A full quorum was in attendance. Present were: Mayor Hubert Brodell, City Clerk, Donna K. Jackson, City Attorney, Phillip Crego and eleven council members. Those members were: Farmer, Province, Hargis, Moore, Williams, Perrin, Street, Young, Dover, McCall, and Roddy. Councilman Copeland was unable to attend.

 

Councilman Perrin moved, seconded by Councilman Moore to approve the minutes of April 21, 2003, as previously delivered. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Moore, Williams, Perrin, Street, Young, Dover, McCall, and Roddy.

 

Finance Director, Larry Flowers gave the monthly financial report ending March 31, 2003. City Collector, Becky Sharp reported she had collected $3,530.37 in revenue from 30 new businesses as well as past due accounts from 2002 and 2003. Councilman Perrin requested that the financial report include an additional column that refers back to the budget. Councilman Young requested the financial report be provided prior to the council meeting so the information could be reviewed. Councilman Young questioned what was being done to prevent erosion of ditches being cleaned out. Councilman Farmer explained the drainage project had begun in September 2002 with no established plan to clean the ditches or prevent erosion problems. He further explained the Infrastructure Committee was currently researching the implementation of a ditch maintenance plan utilizing the Engineering and Street Departments. Councilman Young stated it had been suggested to him that the City use Kentucky 31 fescue on ditch banks for the prevention of erosion. Councilman Farmer questioned if that was Councilman Young’s recommendation, to which Councilman Young responded it was not. The decision was made to leave the decision up to the Engineering Department.

 

The following ordinance was on the third and final reading:

 

ORDINANCE TO REZONE PROPERTY FROM COMMERCIAL C-3 TO RESIDENTIAL R-3 LOCATED ON THE NORTH SIDE OF CONRAD DRIVE, WEST OF CARAWAY ROAD. (Roy Cooper)

 

Councilman Perrin moved, seconded by Councilman Moore for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Moore, Williams, Perrin, Street, Young, Dover, McCall, and Roddy. The ordinance was assigned ordinance number 3406.

 

The following ordinance was on the third and final reading:

 

ORDINANCE TO REZONE PROPERTY FROM COMMERCIAL C-3 TO RESIDENTIAL R-1 LOCATED ON THE NORTHEAST CORNER OF WARREN STREET AND DAYBREAK DRIVE. (Tim Meredith)

 

Councilman Moore moved, seconded by Councilman Hargis for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Moore, Williams, Perrin, Street, Young, Dover, McCall, and Roddy. The ordinance was assigned ordinance number 3407.

 

The following ordinance was on the third and final reading:

 

ORDINANCE TO REZONE PROPERTY FROM RESIDENTIAL R-2 AND COMMERCIAL C-2 TO INDUSTRIAL I-1 LOCATED ON THE SOUTH SIDE OF BURKE AVENUE, WEST OF FLINT STREET, NORTH OF KREWSON STREET AND EAST OF MCCLURE STREET (Best Diversified)

 

Councilman Perrin moved, seconded by Councilman Street for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Moore, Williams, Perrin, Street, Young, Dover, McCall, and Roddy. The ordinance was assigned ordinance number 3408.

 

The following ordinance was on the third and final reading:

 

ORDINANCE TO REZONE PROPERTY FROM RESIDENTIAL R-1 TO COMMERCIAL C-3 LIMITED USE OVERLAY, LOCATED ON THE SOUTHEAST CORNER OF VALLEY VIEW DRIVE AND WEAVER ROAD (Doyle Yarbrough)

 

Councilman Street moved, seconded by Councilman Moore for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Moore, Williams, Perrin, Street, Young, Dover, McCall, and Roddy. Councilman Perrin moved, seconded by Councilman Street for the adoption of the emergency clause. A roll call vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Moore, Williams, Perrin, Street, Young, Dover, McCall, and Roddy. The ordinance was assigned ordinance number 3409.

 

Councilman Street offered the following ordinance for first reading:

Councilman Moore moved, seconded by Councilman Street to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye with the exception of Councilman Farmer who abstained from voting. Those members voting aye were: Province, Hargis, Moore, Williams, Perrin, Street, Young, Dover, McCall, and Roddy. Councilman Perrin moved, seconded by Councilman Street to further suspend the rules and place on the third and final reading. A voice vote was taken resulting in all members voting aye with the exception of Councilman Farmer who abstained from voting. Those members voting aye were: Province, Hargis, Moore, Williams, Perrin, Street, Young, Dover, McCall, and Roddy. Councilman Moore moved, seconded by Councilman Street for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye with the exception of Councilman Farmer who abstained from voting. Those members voting aye were: Province, Hargis, Moore, Williams, Perrin, Street, Young, Dover, McCall, and Roddy. Councilman Perrin moved, seconded by Councilman Dover for the adoption of the emergency clause. A roll call vote was taken resulting in all members voting aye with the exception of Councilman Farmer who abstained from voting. Those members voting aye were: Province, Hargis, Moore, Williams, Perrin, Street, Young, Dover, McCall, and Roddy. . The ordinance was assigned ordinance number 3410.

 

Councilman Farmer moved, seconded by Councilman Dover for the adoption of a resolution adopting a calendar for the preparation and adoption of an annual budget as recommended by the Finance and Administration Committee. Mayor Brodell stated the resolution was aggressive and expressed his concern in being able to adhere to the time line established by the resolution. Councilman Farmer explained it was the first steps in establishing a three-year capital improvement plan in order to provide a need assessment for the City of Jonesboro. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Moore, Williams, Perrin, Street, Young, Dover, McCall, and Roddy. The resolution was assigned number 2003:26.

 

Councilman Farmer moved, seconded by Councilman Street for the adoption of a resolution establishing procedures for the payment of goods and services not procured in accordance with provisions of the Jonesboro Purchasing Manual as recommended by the Finance and Administration Committee. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Moore, Williams, Perrin, Street, Young, Dover, McCall, and Roddy. The resolution was assigned number 2003:27.

 

Under new business, Councilman Young announced a Parks Committee meeting for 3:00 p.m. at City Hall. He also informed council members that Attorney Jim Lyons would be representing the Willet family and all correspondence should be sent to Attorney Lyons.

 

Councilman Dover inquired of the status relating to inventory for GASB 34 requirements. Street Superintendent Gene Barnett reported 80% of the overall inventory had been completed and should have no problem having everything complete by the end of the year.

 

Councilman Farmer inquired about a lawsuit that contained a twenty- day response deadline. Mayor Brodell reported the case had been sent to Attorney Ralph Ohm who would respond.

 

Councilman Farmer moved, seconded by Councilman Moore to accept the following low bid meeting bid specifications:

•2003:31 - Culvert work Mardis - LS - Alvin Crabtree Construction for $45,620.00

•2003:32 - Culvert work Shadow Ridge - LS - Cameron Construction for $49,400.00.

•2003:33 - Culvert work Quail Ridge - LS Ditch Cleaning - Richard Baughn for $41,995.33.

•2003:34 - Layman Crest Detention Pond - LS - Alvin Crabtree for $9,000.00.

 

A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Moore, Williams, Perrin, Street, Young, Dover, McCall, and Roddy.

 

Councilman Farmer moved, seconded by Councilman Moore for the appointment of Paula Thompson to replace Mr. Roy Cooper to serve as representative for Jonesboro Public Schools on the City Water and Light Board. A voice vote was taken resulting in all members voting aye with the exception of Councilman Province who serves on the school board, and Councilman Young who serves on the City Water and Light Board. Those members were: Farmer, Hargis, Moore, Williams, Perrin, Street, Dover, McCall, and Roddy.

 

Councilman Province announced a Parking Subcommittee meeting for May 13th at 4:30 p.m. at the Huntington Building.

 

With no further business, Councilman Moore moved, seconded by Councilman Street for adjournment. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Moore, Williams, Perrin, Street, Young, Dover, McCall, and Roddy.
