MAPC   MINUTES

MARCH 15, 1985

 

The Metropolitan Area Planning Commission met Thursday, March 15, 1985, at 7:00 p.m. in the Council Chambers,314 West Washington, Jonesboro, Arkansas to consider the following requests:

 

MEMBERS PRESENT: Mr. White, Chairman: Mr. Ball; Mr. Blalock; Mrs. Mr. McCracken; Mr. Lusby; Mr. Orr; Mr. Vance; Mr. Hunt

 

MEMBERS ABSENT:  None

 

OTHERS PRESENT: Mr. Joe Tomlinson, City Inspector; Mr. Freddie Hendrix, City Engineer; Mr. Tim Ray;  Mr. John Broadaway:  Mrs. Linda West; Mr. Curt Hodges,  Jonesboro Sun.

 

#1     Bill Rogers and Ben Bush requests a rezoning from Residential One (R-1) to Residential Three (R-3) the following described property: TRACT A: part of the Southwest corner of Section 13, Township 14 North, Range 3 East.  The general location of this property is North of West Washington Avenue.   This Item was WITHDRAWN.

 

#2    J. T. and Sybel Barr request a rezoning from Industrial One ( I-1) to Residential Three (R-3) on the following described property: Lots 18 through 25, Block B, Stuck and Stuck 2nd Addition  to Jonesboro, Arkansas, containing 4.93 acres and subject to a 10' easement along the East side of the track.  The general location of this property is East of Callion Street between Belt Street and Johnson Avenue.

 

Mr. Vance made the motion to approve J. T. and  Sybel Barr’s  requests  for a  rezoning  from Industrial One  (I-1)  to  Residential  Three (R-3).  Seconded by Mrs.Barber.  The Motion to Approve was APPROVED UNANIMOUSLY.

 

#3   Carroll Caldwell and H. S. C. request a rezoning from Residential Two (R-2) to Residential One (R-1) the following described properties in Marshall Estates: Block A., a part of Lot 4 and all of Lots 4 through 16.  Also in Block B, a part of Lot 12 and all of Lots 13 through 18 and a part of  Lots 19  and  20.  They are also requesting a rezoning from Residential One (R-1) to Residential Two (R-2) the following described properties in Marshall Estates: A part of Lot 17 of Block B.  The general location of this property is South of East Matthews Avenue and West of Marjorie Drive.

 

Mr. McCracken made the motion to approve Mr. Caldwell’s and H. S. C. request for a rezoning from Residential Two  (R-2)  to Residential One  (R-1);  and  also  requesting  a  rezoning  from Residential  One (R-1) to Residential Two  (R-2).  Mr. Orr seconded.  The motion to Approve was APPROVED UNANIMOUSLY.

 

#4 W.E. Hancock requests a rezoning from Residential One (R-1) to Residential Two (R-2), the following described property: Lot three (3), Arnold Height Addition, City of Jonesboro. The general location of this property is West of South Culberhouse St. and  North of Parkview St. Mr. Lusby made the Motion to Deny Mr. Hancock’s request for a rezoning from Residential One (R-1) to Residential Two (R-2) due to the fact that the Commission felt that the zoning requested was  not  capatible  with  the  surrounding  area,  and  that,  it  would  be  a  form of  spot  zoning.

 

The motion to Deny was APPROVED UNANIMOUSLY.

 

#5   Maxie Stem requests a rezoning from Residential One (R-1) to Residential Three (R-3), the following described property: part of the Northeast Quarter of the Southwest Quarter of Section 10, Township 14, North, Range 4, East.   The general location of this property is West of Airport and North of Pamela.  This Item was WITHDRAWN.

 

#6   Carol Rhein requests a rezoning from Residential Three (R-3) to Commercial Three (C-3), the following described property: A part of the Southeast Quarter of the Northwest Quarter of Section 36, Township 14, North, Range 3, East.  The general location of this property is West of Highway 49 South and East of Candlewood Addition.

 

Mr. McCracken made the Motion to approve Mrs. Rhein Request from Residential Three (R-3) to Commercial Three (C-3) due to the fact that the general trend of the area is to Commercial. 

 

Mr. Ball seconded. This Motion  to approve was  APPROVED  unanimously.

 

#7   Carol Rhein requests a replat of Lots A and B or a part of the Southeast Quarter, Northwest Quarter, Section 26, Township 14 North, Range 3, East.  The general location of this property is West of Highway 49 South and East of Candlewood Addition.

 

Mr. Vance questioned the drainage problem and Mr. Ball made the motion to approve this request with the following stipulations:

 

1.)                     That Mrs. Rhein presents a Site Plan showing building Lot.

2.)                     City Engineer, Freddie Hendrix, investigate the drainage problem on the North end of  the  property.

 

Mr. Lusby seconded.  This motion to approve was APPROVED unanimously.

 

#8    Jay Lee requests a replat of Lots 8 and the South half of Lot 7, Gregg and Houghton’s Subdivision into Lots 1 and 2.  The general location of this property is East of Main Street and West of Church Street.

 

Mr. Vance made the motion to approve the request.  Mr. Lusby seconded.  This motion to approve was APPROVED   unanimously.

 

#9                     Louis Hartley requests final approval of construction plans for Lakewood Third Addition, a Planned Unit Development, to be located on the part of the Southeast Quarter of the Northwest Quarter, Section 32, Township 14, North, Range 4 East.   The Development covers 7.125 acres and contains 60 units in 15 buildings, for a density of 8.4 units per acres.  The  property  is  East  of  Old Highway 1  and  South  of  Medallion  Acres.

 

Mr. Vance made the Motion to approve the request for final approval with the following stipulations:

 

1.)                       The City Engineer  must  review  Plats  before  they  are  recorded.

2.)                     Sheet Four (4) of Five (5) must be changed showing modified curb instead of depression on parking area of Lakewood an Matlock

 

Mr. Orr seconded.  This Motion to Approve for Final Approval was APPROVED unanimously.

 

#10                     Mr. Guy Pardew requests final approval of construction plans for Tanglewood Addition, a Planned Unit Development, to be located on  part of the North half, Southeast Quarter, Section 23,  Township 14, North, Range 3, East.  The development covers 2.26 acres  and  contains  20 units in five (5) buildings, for a density of 8.84 units per acre.   The property is zoned R-2.  The general location of this property is West of Loberg and North and South of Tanglewood Dr.

 

City Engineer, Freddie Hendrix, gave a report on the drainage and made the statement that the pipe would be sufficient and should hold up.  Mr. Vance made the Motion to approve final approval of construction with the following stipulations:

1.)                       That the existing fence would be sufficient, however, it would need to be repaired.

 

Mr. Lusby seconded.  The Motion for Final Approved was APPROVED unanimously.

 

#11    Maxie Stem requests preliminary approval of construction plans for Chelsea Heights, a Planned Unit Development, to be located on a part of the Northeast Quarter, Southwest Quarter, of Section 10, Township 14, North Range 4, East.  The development covers 5.083 acres and contains 25 units in 25 buildings, for a density of 6.46 units per acre. The property is zoned R-1. The general location of this property is West of Airport Road and North of Pamela.

 

No  action  was  taken  due  to  the  fact  that  the  legal ad  did  not  appear  in  the  local  paper.  The  Commission  did  agree  to  hear  discussion  from  both  sides  upon  Mr. Stem’s  request.

 

#12    Maxie Stem  requests  approval of revised  site  development  plans  for  an  apartment complex  to  be  located  on  Lot 1,  Block A,  Stem First Addition.  The  general  location  of  this  property  is  South  of  Race  Street  and  East.

 

Mr. Lusby made the Motion to Approve the revised site development plans with the following stipulations:

 

1.)                       That a modified curb must be constructed on each entrance into the property.

 

Mr. McCracken seconded.  The motion to approve the Revised Site Development Plan was APPROVED: Voting aye were Mr. Blalock; Mr. McCracken; Mrs. Barber; Mr. Vance; Mr. Lusby; Mr. Ball; Mr. Hunt.  Abstaining: Mr.Orr Motion: /voting Approved 8 to 1.

 

#13    Max Dacus request approval of a Revised Site Plan for Dacus Mini Storage to be located on Lot 2, Block A, Rose Stickler Addition.  The general location is North of Cain and West of Nettleton.

Mr. Ball made the Motion to Approve the Revised Site Plan with the following stipulations:

 

1.)                     Developer must bring a replat to correct a building encroachment.

2.)                     The Replat should also show a drainage easement along North side of the property.

 

Mr. Hunt seconded.  This Motion to approve was APPROVED unanimously.

 

#14   Max Dacus, Jr. request a Replat of Lots 4 and 5 of Mode Gregory Addition to Jonesboro, Arkansas into the Dacus Replat of apart of Mode Gregory Addition.  The general location of this property is North of Warner Avenue and East of Gee.

 

Mr. Vance made the Motion to Approve the request of a Replat.  Mr. Ball seconded.  This Motion to Approve was APPROVED unanimously.

 

#15   Downtown Church of Christ  requests  a  Replat of  the  North 179.0  Lot 11 of  Stratford Heights First Replat, and a part of the Southeast Quarter, Southeast of Section 14, Township 14,Range 3, East.  The general location of this property is Couth of West Washington Avenue and West of Stratford Drive.

 

Mr. Vance made the Motion to Approve the request for a Replat.  Mr. Lusby seconded.  This Motion to Approve was APPROVED   unanimously.

 

#16   Downtown Church of Christ request a zoning classification of Residential Two (R-2).

Subject zoning request is submitted under the provisions of City Ordinance #1473 providing for zoning classification prior to the subject property being annexed to the City.   The MAPC is asked to prepare a written statement as to what affect the proposed annexation would have on the City accepting said land.  The property is described as follows: The   North 179.0 feet of Lot 11 of Stratford Heights First Replat; and a part of the Southeast Quarter of the Southeast Quarter of Section 14, Township 14, North, Range 3, East, containing 3.00 acres.  The general location of   this property is south of West Washington Avenue and West of Stratford Drive.

 

Mr. Vance made the Motion to approve this request with the following stipulations:

 

1.)    Owner provide Site Plan to M.A.P.C. before the building permit will be issued-owner must address the following:

A.   Underground 18" drainage pipe running full length of property.

B    Drainage Culverts and drop-inlets along Washington Stratford Drive which will be agreeable to the City Engineer, Freddie Hendrix

C.   Curb and gutter along Stratford Drive and Washington.

D.   Build one-half of Stratford Drive.

Mr. Blalock seconded.  This Motion Approved was APPROVED unanimously.

 

#17    Brentwood Properties requests preliminary approval of construction plans for Brentwood Subdivision, to be located on a part of the Northwest Quarter, Northwest Quarter, Section 13, Township 14, North, Range 4, East, containing 25.18 acres more or less.  The development will contain 62 lots and is zoned Residential One (R-1).  The general location of this property is South of Parker Road and East of South Culberhouse.

 

Mr McCracken made the Motion to approve the request for preliminary approval of construction Mr. Vance seconded.

 

There was much discussion, and Mr. McCracken Amended his Motion due to a question regarding drainage.  Due to drainage problems, City Engineer, Freddie Hendrix, was asked to work with the Developer to solve these problems.  Mr. McCracken Motion to Approve was APPROVED unanimously.

 

#18: Floyd Vuncannon requests a Replat of Lots 11 through 16, Block 1, Sigler College Addition. The general location of this property is North of Forrest Home Road and West of Bittle.

 

Mr. Vance made the Motion to Approve with the following stipulations: 

1.)                     Site Plan be reviewed by City Inspector and City Engineer.

2.)     That a 7 ½' (foot) easement West side of Lot 2 and 3; 7 ½'  (foot) easement North side of Lot 3; 10'  (foot) easement running East and West between 1, 2, and 3.

3.)                     Owners provide Site Development Plan showing curb and gutter along all streets.  Before Building permit is issued the City Engineer and City Inspector must review and approve this plan.

 

Mr. Lusby seconded.  This Motion to Approve was APPROVED   unanimously.

 

#19    David Perciful requests a Replat of the East half of Lots 1, 2, 3, 4 of Stephenson’s Addition.  The general location of this property is North of Aggie and West of Patrick.

 

Mr. Lusby made the motion to approve with the following stipulation:

 

1.   The Replat needs to be corrected to show a 20' (foot) right-of-way of Patrick Street.

 

#20    MAPC Agenda Page 3 (Page 7 Minutes missing)   John Gross requests a replat of Lot 1 and Lot 2 of United Development Corporation.  The general location of this property is South of Matthews and West of Marjorie Drive.

 

#21     MAPC  Agenda  Page 3  (Page 7 Minutes missing)  Brodell and Roach  requests  a  replat of  a  part  of  Lot 1,  Bob G. Bennett  East Washington Subdivision.  The general location of this property is South of Washington and North of Logan.

 

#22   James Darnell requests approval of site Development Plans for two buildings on one lot to be located on Lot 3, Block 7, of  Culberhouse Third Addition.  The general location of this property is North of West Cherry  and  East  of  Olive.

 

Mr. Ball made a Motion to deny on the basis that the Ordinance requires only one (1) principal building and will not be compatible with existing neighborhood.

 

Voting Aye: Mr. McCracken; Mr. Orr; Mr. Barber; Mr. Ball; Mr. Hunt. Voting No: Mr. Blalock; Mr. Vance; Mr Lusby.

 

This Motion  was  Approved  to  Deny  Mr. Darnell’s  request  by  a  five  three  ratio. ( Five voting  aye  and  three  voting  nay).

 

#23   Maxie Stem requests a replat of a part of the Northeast Quarter of the Southwest Quarter of Section 10, Township 14, North, Range 4, East.  The general location of this property is West of Airport and North of Pamela.
