AN ORDINANCE CREATING A CITY LANDFILL MANAGEMENT COMMISSION; AND FOR OTHER PURPOSES

Section 1: In order to insure that the City of Jonesboro complies with the provisions of Arkansas Statute Section 82-2701 et seq. and other state laws pertaining to solid waste disposal, there is hereby created a City Landfill Management Commission.

 

Section 2: This Commission shall consist of six (6) members. Five (5) members shall be appointed by the Mayor subject to confirmation by the City Council. The City Engineer shall be an ex-officio member of the Commission. He shall not be entitled to vote on matters before the commission. In making his selection for membership on this Commission, the Mayor shall endeavor to choose individuals who use or whose employers use the landfill. These individuals should be in a position to know or readily ascertain what practices are in effect, how the actual practices conform to published guidelines and requirements and what, if any, changes would improve the city landfill operations. A majority of the membership shall constitute a quorum for the transaction of business. The members of the Commission shall be appointed for a two-year term except for the City Engineer. They shall serve without compensation. However, the City may reimburse members for reasonable expenses incurred in the discharge of membership duties.

 

Section 3: It shall be the function and purpose of this Commission to oversee generally the procedures and practices of the city landfill, to develop guidelines and requirements for use of and compliance by landfill users, and to submit an annual report of such guidelines and requirements to the City Council. This Commission shall insure that the City’s landfill operations are maintained in accordance with applicable federal, state and local laws and regulations. It shall be the Commission’s responsibility to insure that users of the landfill are held accountable for any misuse or abuse of the landfill. The Commission shall also insure that the landfills are managed and operated as to cause no health hazard, to conform to reasonable esthetic standards and to represent an efficient, inexpensive discharge of the waste disposal function. This Commission shall also be responsible for acting as liaison with state and other public environmental authorities in order to meet the landfill requirements of these higher authorities.

 

Section 4: The City Engineer, as ex-officio member of this Commission, shall be responsible for keeping the Commission informed of landfill related activities such as inspections by appropriate regulatory authorities, user violations, and budget matters. The City Engineer shall also be responsible for receiving recommendations from the Commission and implementing such recommendations.

 

Section 5: The membership shall hold meetings not less than once every two months, the time and place to be agreed upon by the membership. The members of the Commission shall elect a Chairman, Vice-Chairman and a Secretary.

 

Section 6: The office of the City Engineer shall provide such administrative assistance to the Commission as may be necessary such as typing notices and making phone calls.

 

Section 7: Upon the resignation or other departure of a member of this Commission, the Secretary shall notify the Mayor who shall appoint a replacement subject to confirmation by the City Council. The replacement shall serve for the unexpired term of the resigning or departing member.

 

Section 8: A member of this Commission who shall fail to attend three (3) consecutive meetings may be requested to resign on motion by any other member of the Commission. Such member will be expected to tender his or her resignation unless the absence was caused by extenuating circumstances.

 

Section 9: At the end of each calendar year, the Commission shall make an annual report to the Mayor and City Council. This report shall be made before the first day of March of the following year. The report may be made either orally or in writing. This report shall include a summary of the recommendation s made by the Commission during a report year, together with a copy of the procedures and guidelines which have been promulgated by the Commission pertaining to landfill operations.

 

Section 10: All ordinances and/or parts of ordinances in conflict herewith are hereby repealed.

 

Section 11: Should any portion of this ordinance be unconstitutional or invalid and so declared by a Court of competent jurisdiction, then the remainder of this ordinance shall not be affected by any such partial invalidity.

 

Section 12: It is found and declared by the City Council that this ordinance is necessary for the preservation of the public peace, health and safety. Therefore an emergency is hereby declared to exist and this ordinance shall take effect from and after its passage and approval.
