AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 6; DECLARING THE ZONING FOR THE ANNEXED TRACT; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of a particular tract to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on January 30, 1990; and

 

WHEREAS, said petition for the annexation of these lands was duly signed by a majority of all owners of tracts to be annexed to the City of Jonesboro, Arkansas; and

 

WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held on March 5, 1990, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas; whereupon an order of annexation was made and entered and

 

WHEREAS, thirty (30) days having expired since the order of annexation dated March 5, 1990, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order dated April 6, 1990;

 

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:

 

SECTION 1: All of the territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, by its order dated March 5, 1990, be, and they are hereby accepted by the City of Jonesboro, Arkansas, and said territories hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing herein shall have and enjoy all privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas

 

SECTION 2: The portion of lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:

 

Begin at the southwest corner of the SW 1/4, SW 1/4 of Section 12, T14N, R4E; thence north along the west section line of Section 12 to the southwest corner of Section 1, T14N, R4E; thence continue north along the west section line of Section 1, to the center of Bridger Creek; thence continue southeasterly alone the meanderings of Bridger Creek to the half section line to the northeast corner of the NE 1/4, NW 1/4 of Section 12; thence continue south along the half section line of Section 12 to the northerly right-of-way of the St. Louis and Southwestern Railroad; thence continue southwesterly alone the right-of-way of said railroad to the south section line of Section 12; thence west along the south section of Section 12 to the point of beginning, all located in Craighead County, Arkansas and containing 297 acres, more or less.

 

SECTION 3: The lands and territory annexed to the City of Jonesboro, Arkansas, and thereby accepted by the City of Jonesboro, Arkansas, and hereby accepted by the City of Jonesboro, Arkansas are assigned and attached to Ward 6.

 

SECTION 4: Said lands and territory annexed to the City of Jonesboro, Arkansas, are hereby classified for the purpose of zoning as follows:

 

All property shall be Residential - 1 (R-1) except the following two tracts which shall be zoned Industrial - 1 (I-1):

 

TRACT 1: Begin at the Northwest Quarter of the Southwest Quarter containing 40 acres more or less and the Southwest Quarter of the Southwest Quarter excepting approximately 3 acres previously conveyed to Jim Stevens being one acre with along the highway running east and west and 3 acres north and south in the southwest corner, Section 1, Township 14 North, Range 4 East, Craighead County, Arkansas, being 77 acres more or less.

 

TRACT 2: A part of the Northeast Quarter of the Northwest Quarter, Section 12, Township 14 North, Range 4 East, Craighead County, Arkansas, more particularly described as follows: Commencing at the Northwest Corner, NE 1/4 NW 1/4 of Section 12, T14N, R4E; thence South 0°40' East 13.6 feet to a 1 1/4" pipe set on the South Right-of-way line of Highway #1 and the point of beginning proper; thence North 88°45' East along said right-of-way line 420.2 feet to a 1/4" pipe set; thence South 0°40' East 13.6 feet to a 1 1/4" pipe set on the South right-of-way line of Highway #1 and the point of beginning proper; thence North 88°45' East along said right-of-way line 420.2 feet to a l 1/4" pipe set; thence South 0°46' West 624.1 feet; thence South 86°46' West 405.5 feet; thence North 0°40' West 637.7 feet, to the point of beginning proper and containing 5.97 acres.

 

SECTION 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas that there is an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits, and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory, therefore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage.

 

PASSED AND ADOPTED this 7th day of May, 1990.
