IN THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS IN THE MATTER OF THE ANNEXATION OF UPPER DUCKSWATER ADDITION, FIRST REVISION NO. CO 85-37. AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS BY ORDER OF COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 4; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-1); DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas hereinafter described was duly filed in the County Court of Craighead County, Arkansas on June 5, 1985; and,
WHEREAS, said petition for annexation of said lands was duly signed by the sole owners of the acreage to be annexed to the City of Jonesboro, Arkansas; and,
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas on July 12, 1985 at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an order annexation was entered; and,
WHEREAS, thirty (30) days have expired since the order of annexation dated July 12, 1985 was entered and no proceedings to prevent said annexation having been filed with the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas by its order of August 16, 1985;
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas by its order of July 12, 1985 be and hereby are accepted by the City of Jonesboro, Arkansas and said territory hereinafter described shall be hereafter deemed and taken to be part and parcel of the limits of the City of Jonesboro, Arkansas and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas are move particularly described as follows: (R-1) - James L. Schrantz, Upper Duckswater Addition, off Wood Springs Rd, near Robinwood.
Lots 1-23 of Upper Duckswater Addition, First Revision, as shown by recorded Plat in Plat Cabinet A at Page 191 and subject to Bill of Assurance recorded in Deed Record 319 at Pages 766-774 and further subject to all easements and setback lines as shown on the recorded Plat.
Section 3: The lands and territory annexed to the City of Jonesboro, Arkansas are hereby accepted by the City of Jonesboro, Arkansas are hereby assigned and attached to Ward 4 to the City of Jonesboro, Arkansas.
Section 4: Said lands and territory annexed to the City of Jonesboro, Arkansas are hereby zoned residential (R-1).
Section 5: The owners of lots located in the lands herein accepted shall have the right to maintain a security gate in the vicinity of the intersection of Duckswater Street and Arkansas State Highway 226, popularly known as Wood Springs Road, provided said security gate is so located and maintained as not to curse hindrance or hazard to highway traffic or interference with maintenance of utilities and further provided that the design, construction, operation, and maintenance of said gate meet with the approval of the City Engineer, the Chief of Police, and the Fire Chief of this City.
Section 6: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas so that said property and the citizens and property owners of said territory described herein can b entitled to fire, police, zoning, and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore an emergency is declared to exist and this ordinance, being necessary for the preservation of the public peace, health, and safety, shall take effect and shall be in full force from and after its passage.
