AN ORDINANCE ABANDONING EASEMENTS LOCATED IN THE CITY OF JONESBORO, ARKANSAS

WHEREAS, the City Council at its regular meeting hearing the request to abandon two easements described as follows:
LEGAL DESCRIPTION - TRACT 1
Part of Lot 13 of Block D of Dunwoody-Huntcliff Estates to the City of Jonesboro, Craighead County, Arkansas being more particularly described as follows: Begin at the Northeast corner of Lot 13 of Block D of Dunwoody-Huntcliff Estates to the City of Jonesboro, Craighead County, Arkansas, thence south 89°49'41" West along the north line of said Lot 13, 132.46 feet to the point of beginning proper; thence south 40°53'17" East 143.14 feet to the northwesterly Right of Way line of Wolf Chase Lane; Thence southwesterly along said right of way line along the arc of a 28.65° curve to the right with a radius of 200.00 feet and a distance of 20.12 feet; Thence North 40°53'17" West 162.50 feet to the North line of Lot 13, aforesaid; thence North 89°45'41" East along said North line 26.36 feet to the point of beginning proper.
LEGAL DESCRIPTION - TRACT 2
Part of Lots 1 and 2 of Block E of Dunwoody-Huntcliff Estates to the City of Jonesboro, Craighead County, Arkansas being more particularly described as follows: Begin at the northwest corner of Lot 1 of Block E of Dunwoody-Huntcliff Estates to the City of Jonesboro, Craighead County Arkansas, Thence northeasterly along the east right of way line of Wolf Chase Lane along a 28.65° curve to the left with a radius of 200.00 feet and a distance of 10.00 feet; Thence south 43°00'00" East 143.86 feet; thence south 22°00'00" west 110.93 feet to the North right of way line of Dunwoody Drive; Thence South 89°54'15" West along said North right of way line 21.59 feet; Thence North 22°00'00" East 106.31 feet; Thence North 43°00'00" West 131.12 feet to the east right of way line of Wolf Chase Lane; Thence northeasterly along said east right of way line along the Arc of a 28.65° curve to the left with a distance of 10.00 feet to the point of beginning.
WHEREAS, the City Council held a public hearing and heard all persons desiring to be heard in connection with this matter; and
WHEREAS, the abandonment of easement would not affect the use of and would be in the best interest of all parties concerned
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
SECTION 1: The City of Jonesboro, Arkansas, hereby vacates and abandons all of its rights, together with the rights of the public generally in Jonesboro, Arkansas.
SECTION 2: A copy of this ordinance duly certified by the City Clerk shall be filed in the Office of Recorder of Craighead County at Jonesboro, Arkansas, and recorded in the Deed records of Craighead County, Arkansas.
SECTION 3: The closing, vacating and abandonment by the City of its rights and the rights of the public generally in the above described portion of the easement is in the public interest and will promote the public peace and welfare. And further, the City Council finds that an emergency exists and this ordinance being necessary for the protection and promotion of the public health, welfare and safety, the same shall take effect form and after its passage and approval.
