AN ORDINANCE FOR THE REZONING OF CERTAIN PROPERTY LOCATED IN JONESBORO, CRAIGHEAD COUNTY, ARKANSAS, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS: Bearl and Loretta Brooks are the sole owners of the real property described below situated in Jonesboro, Craighead County, Arkansas; and
WHEREAS, said property has been zoned as commercial property; and
WHEREAS, the owners of said property are desirous of rezoning this property to residential (R-2) classification; and
WHEREAS, said rezoning is in the best interest of the owners, the surrounding property owners and the Citizens of Jonesboro, Craighead County, Arkansas.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Craighead County, Arkansas:
Section 1: It is hereby found and declared that the following described real property, situated in Jonesboro, Craighead County, Arkansas, formerly zoned as commercial property, shall hereinafter be zoned as Residential property (R-2) classification:
A part of the North Half of the Northwest Quarter of Section 4, Township 13 North, Range 4 East, being more particularly described as follows: Begin at the Southeast corner of the Northeast Quarter of the Northwest Quarter of Section 4, Township 13 North, Range 4 East; thence S 89°24’ W on the 40 acre line 996.73’; thence N0°23’ W parallel with the East line of said Northeast Quarter of the Northwest Quarter 30’ to the point of beginning proper; thence continue N0° 23’ W parallel with the East line of said Northeast Quarter of the Northwest Quarter 500’; thence S 89°24’ W parallel with the South line of aforesaid North Half of the Northeast Quarter 331.94’; thence S0°23’ E parallel with the East line of said Northeast Quarter of the Northwest Quarter 500’ to a point 30’ North of the South line of said North Half of the Northwest Quarter; thence N89° 24’ E parallel with the South line of said North Half of the Northwest Quarter 331.94’ to the point of beginning proper, containing 3.81 acres, subject to the completion of street improvements, comparable to those immediately west, of this property.
Section 2: It is hereby found and declared by the City Council of the City of Jonesboro, Craighead County, Arkansas, that the zoning of the above-described real property shall be and is in the best interest of the owners, the surrounding property owners and the citizens of Jonesboro, Craighead County, Arkansas.
Section 3: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency and that said benefits and protections are urgently needed now in order to allow orderly development of said lands and territories. Therefore, an emergency is hereby declared to exist; this ordinance being necessary for the preservation of the public peace, health and safety shall take effect and be in full force from and after its passage and approval.
