AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR THE CHANGE IN ZONING BOUNDARIES FROM R-1 TO C-3 LOCATED ON THE HIGHWAY 63 BYPASS WEST OF THE FRANCOIS PROPERTY AS REQUESTED BY CARROLL MARTIN, ATTORNEY SKIP MOONEY

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

SECTION 1:   That Ordinance No. 954 known as the Zoning Ordinance of the City of Jonesboro be amended as recommended by the Metropolitan Area Planning Commission by the change in zoning district boundaries as follows: Hwy 63 Bypass, W. of Francois property, Carroll Martin - Mooney.

 

From Residential (R-1) to Commercial (C-3) of property described as follows:  A part of  the  Southwest Quarter of the Southeast Quarter of Section 23, Township 14 North, Range 3  East,  being more particularly described as follows: Begin at the Southeast Corner of the Southwest  Quarter of the Southeast Quarter of Section 23, Township 14 North, Range 3 East;  thence North  on the 40 acre line 188.2 feet to the point of beginning proper; thence South  71°12'  West  501.5  feet to the Northerly right-of-way line of U.S.  Highway  No. 63  By  Pass;  thence  with  the  meanderings with said right-of-way line as follows: North 47°25'  West 149.7 feet; North 42° 46' West  326.66 feet; North  50° 19' 07" West 375.71 feet; North 40° 21' 52" West 39.22 feet;  thence North 49°38' 08" East 144.85 feet to Block A of Briarwood Fourth Addition:; thence with the meanderings with Block A as follows: South 30° 01' 34" East  419.70 feet; North 51° 15' 51"  East 488.70  feet;  North 7°50' 19"  East  22.45  feet;  North  88° 42'  East 102.9  feet; North 88°41'  East 79.94 feet;  North 88°43'  East 241.65 feet to the 40 acre line; thence South on  the  40 acre line 471.7 feet to the point of beginning  proper, containing 9.06 aces, more or less  and  being subject to all rights-of-ways and easements of  record.   

 

SECTION 2:    It is found and declared by the City Council that proper use of the tract of land described in this Ordinance is being delayed because of improper zoning and that, therefore, an emergency exists and this Ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect from and after its passage and approval.
