AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED OCTOBER 1; ASSIGNING SAID ANNEXED TERRITORY TO WARD 4 DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES (NOTE: THIS ORDINANCE WAS AMENDED BY ORD-75:2253 ON AUGUST 18, 1975)

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described was duly filed in the County Court of Craighead County, Arkansas, on August 20, 1973, and
WHEREAS, said petition for the annexation of said land was signed by all of the real estate owners, owning all of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing, and a hearing upon said petition was duly had and held in the County Court on October 1, 1973, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, whereupon an order of annexation was made and entered; and
WHEREAS, thirty (30) days have expired since the order of annexation dated October 1, 1973, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court by its order of November 21, 1973.
NOW THEREFORE, be it ordained and enacted by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, by its order of October 1, 1973, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows, to-wit:
Part of the Northeast Quarter of the Southwest Quarter (2.18 acres), part of the Southwest Quarter of the Southeast Quarter (18.86 acres), and part of the Northwest Quarter of the Southeast Quarter (10.52 acres) all being in Section Twenty-three (23), Township Fourteen (14) North, Range Three (3) East, Craighead County, Arkansas, and being more particularly described as follows: Commencing at the Northeast corner of the Southeast Quarter, Section 23, aforesaid; thence South 89°30' West along the North line of said Southeast Quarter 1430.8 feet to the point of beginning proper; thence South 0°20' East 253.4 feet; thence along the arc of a 22.888 degree curve to the right 67.7 feet; thence South 15°10'25" West 100.0 feet; thence along the arc of a 21.574 degree curve to the left 53.7 feet; thence South 3°35' West 277.8 feet; thence North 89°48' East 529.9 feet; thence South 21°22' West 122.0 feet; thence South 9°26' West 176.8 feet; thence South 89°28' West 474.5 feet; thence South 3°35' West 280.6 feet; thence North 89°27' East 169.0 feet; thence South 1°10' West 660.0feet;thence South 89°43' West 425.3 feet; thence North 9°12' East 23.6 feet; thence South 52°25' West 489.0 feet; thence North 28°49' West 995.7 feet; thence North 1°06' East 413.0 feet; thence South 65°29'23" East 175.4 feet; thence South 72°04' East 210.9 feet; thence South 73°22' East 209.4 feet; thence South 81°13' East 202.7 feet; thence South 78°44' East 185.7 feet; thence North 0°20' West 843.2 feet; thence North 89°40' East 194.4 feet; thence North 15°10'25" East 86.6feet; thence along the arc of a 30.104 degree curve to the left 51.5 feet; thence North 0°20' West 253.14 feet to the aforementioned North line of the Southeast Quarter; thence North 89°40' East along said line 60.0 feet to the point of beginning proper and containing, in all, 31.56 acres, more or less, said lands also described as Briarwood 4th Addition to the City of Jonesboro, Arkansas, as shown by plat in Deed Record 179 at Page 95.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 4, of the City of Jonesboro, Arkansas.
Section 4: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro so that said property may be included in the city's next census count; and that it is in the interest of the City of Jonesboro and the citizens and property owners of said territory that is set out above can be entitled fire, police, zoning and other protection and benefits, and that said benefits and protection are urgently needed now in order to allow the growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist, and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect and be in full force from and after its passage.
